UPDATES FROM SYNERGY & BEN BERRY

Update 4/2/21

On QENC (Queench, Inc.) the registered agent was finally served after over forty hours of attempted service (according to the process server). This case can now move forward. My attorney requested a hearing with the court yesterday (4/1). Parties have 14 days from filing to respond before a hearing can be scheduled.

On BDCM (Broadcast Marketing Group, Inc.) the judge signed the order and Synergy is now the custodian. I have reached out to the TA to request records and will begin the process of bringing the SOS filings current.

 

On the custodian petitions in Delaware court of Chancery. I have no updates and we are continuing to wait on an opinion from the amicus curiae (Mr. Gentile). He was tasked with consulting with the SEC to provide an independent review on whether the petitions should be granted.

Please note, I do not have any information and I am awaiting the courts decisions on all cases. I have no opinion or insight on whether these will be granted or denied. If you have questions, please correspond directly with the courts. I am getting inundated with emails/calls and it is getting hard to respond to all. I know many shareholders sent letters of support to Chancellor Bouchard; however, I am not sure if he passed these on to the vice chancellors when he reassigned the cases. If you want to lend your support, I suggest sending a letter to the respective vice chancellor.
